Will New FDA Approval of Gardasil Vaccine for Adults Lead to Mandatory Gardasil Vaccination?

After the U.S. Food and Drug Administration’s (FDA) approved Merck’s HPV-9 Gardasil vaccine for use in adults age 27 to 45 in 2018, the Centers for Disease Control’s (CDC) Advisory Committee on Immunization Practices (ACIP) of the Department of Health and Human Services (HHS) is evaluating whether to expand their current HPV vaccine recommendation to include this new age group. ACIP’s current recommendation is that boys and girls ages 9 through 15 should get two-doses of HPV-9. The “catch-up” vaccine schedule is a three- dose series for females above age 15 through age 27 and males above 15 years of age to 21 years of age, if not previously vaccinated with HPV vaccine. Should ACIP expand their recommendations for use of HPV-9 vaccine in the newly approved age group, the CDC won’t be alone in the push to increase the use of the HPV vaccine by children and adults in the U.S. During the September meeting of the National Vaccine Advisory Committee (NVAC), a federal advisory committee that makes recommendations to the National Vaccine Program Office (NVPO), the HHS Assistant Secretary ADM Brett Giroir M.D. emphasized that HHS supported the NVAC’s HPV vaccine recommendations published in June 2018. Dr. Giroir stated that increasing HPV vaccination in America would be a focus for HHS in 2019. The federal government’s focus on increasing the use recommendations for the HPV vaccine may result in a renewed effort by state legislators to introduce legislation in many states to mandate HPV vaccine for school entry.

There have been 101 cases of measles that have been reported in 10 states since the beginning of 2019, hardly a public health emergency in a U.S. population of more than 320 million people where 94 percent of school children have received two doses of MMR vaccine and only two percent of children have a vaccine exemption for any reason. In what looks like a repeat of the “measles in Disneyland” media feeding frenzy that stampeded California state legislators into eliminating the personal belief vaccine exemption in 2015, the tiny minority of parents who have made a conscious choice not to give their children every one of the dozens of doses of federally recommended and state mandated vaccines are being once again relentlessly stereotyped, demonized and bullied. In what appears to be another well-orchestrated campaign to pressure state legislatures to remove all personal belief vaccine exemptions in the U.S. and further restrict already narrow medical exemptions to vaccination, forced vaccination proponents are whipping up irrational fear to justify attacking human rights, including freedom of thought, speech, religious belief and conscience. It is a spectacle unworthy of a nation where human rights and civil liberties have been valued since the ratification of the Bill of Rights in the U.S. Constitution in 1789 and the informed consent principle became the anchor for medical ethics after World War II.

Breaking these 113 bills down by our NVIC position registered on the NVIC Advocacy Portal, we support on 48, oppose 60, and we are watching to see what happens with 5. We are just a little over a month into most legislative sessions, so we are expecting more bills affecting even more states to still be filed. It is important that you make your position to bills that affect your rights known to your legislators. Everyone should be visiting or calling their own State Representative and State Senator and asking them to OPPOSE any restriction or removal of personal, religious or medical exemptions to vaccine mandates.

BREAKING: FDA Sued as CDC Recommends Untested, Unlicensed Flu Vaccine for Pregnant Women

In response to a Freedom of Information Act (FOIA) lawsuit, the FDA has admitted, for the first time, that government agencies, including the CDC, are recommending vaccines for pregnant women that have neither been licensed for pregnant mothers by the FDA nor tested for safety in clinical trials. The lawsuit, filed by Children’s Health Defense (CHD) attorney, Robert F. Kennedy, Jr. on behalf of Informed Consent Action Network (ICAN), a vaccine safety advocacy group, sought all clinical trial data used by FDA to approve influenza vaccines for pregnant women. The FDA’s terse reply: “We have no records responsive to your requests.” Robert F. Kennedy, Jr. says, “As a nation, we can no longer pretend our trusted agencies are protecting our children. It is time to hold federal agencies accountable.”

There’s a narrative being spread that the vaccination rate for the measles vaccine has fallen lately due to irresponsible parents, and that the only way to fix the declining rate is to tighten up vaccine exemption laws in every state. Luckily, the CDC has a super-easy, interactive map that answers this question very clearly, and I hope any members of the media with a brain start to take a look at the actual data. When I looked at the CDC’s numbers, it clearly showed that the MMR vaccination rate has held steady for more than 20 years.

On Jan. 16, 2019 the World Health Organization (WHO) issued a report ranking “vaccine hesitancy” as one of the top “Ten Threats to Global Health in 2019.” It is clear that mass media communications today is being controlled by corporations financially tied to pharmaceutical companies and influenced by powerful political institutions in society. It goes a long way to explaining why mainstream media outlets have been united in attacking parents and physicians who defend the ethical principle of informed consent, including informed consent to vaccination, and are calling for vaccine exemptions to be severely restricted or eliminated. The five largest companies in the world today are Apple, Google, Microsoft, Amazon and Facebook. These and other technology corporations dominate online communications and sales and are positioned to join together to aggressively market vaccines and promote “no exceptions” vaccine use policies endorsed by the WHO and governments. The threat to autonomy and freedom of thought and speech posed by these companies, especially in censoring online public conversations about vaccination and health, is considerable.

It was truly a red-letter day. Herd Immunity: A False Rationale for Vaccine Mandates

Herd immunity is a largely theoretical concept, yet for decades, it has furnished one of the key underpinnings for vaccine mandates in the United States. The public health establishment borrowed the herd immunity concept from pre-vaccine observations of natural disease outbreaks. Then, without any apparent supporting science, officials applied the concept to vaccination, using it not only to justify mass vaccination but to guilt-trip anyone objecting to the nation’s increasingly onerous vaccine mandates. Apparently, herd immunity bullying sometimes works: A review of 29 studies showed that “willingness to immunize children for the benefit of the community” was a “motivating reason” for about a third of parents. There is one problem with using herd immunity as a motivator, however—the theory of herd immunity relies on numerous flawed assumptions that, in the real world, do not and cannot justify compulsory vaccination policies. In a 2014 analysis in the Oregon Law Review by New York University (NYU) legal scholars Mary Holland and Chase E. Zachary (who also has a Princeton-conferred doctorate in chemistry), the authors show that 60 years of compulsory vaccine policies “have not attained herd immunity for any childhood disease.” It is time, they suggest, to cast aside coercion in favor of voluntary choice.

Merck’s Hepatitis B Vaccine Shortage Linked to Reduced Deaths In Babies

In the summer of 2017, a malware virus mainly affecting the Ukraine, found its way onto the mainframe computer systems of Merck wreaking havoc for the company. According to the Wall Street Journal, the incident cost the pharmaceutical giant $670 million to remediate, but more importantly, it caused disruption to the production of two of Merck’s pediatric vaccines: Gardasil 9 (Human Papillomavirus) and Recombivax (Hepatitis B virus), vaccines to help prevent sexually transmitted infections. During the crisis, Merck borrowed from a CDC vaccine stockpile, in order to meet supply commitments for Gardasil 9. However, that was not the case with Recombivax, the Hepatitis B vaccine given to all babies beginning the first day of life. There is growing concern among some scientists about the aluminum adjuvant load in vaccines and its effects on the neurological health of children. Researchers are particularly concerned with Merck’s highly immunogenic adjuvant, Amorphous Aluminum Hydroxyphosphate Sulphate (AAHS). Gardasil and Recombivax are the only vaccines licensed to contain AAHS. We now have more than a year’s worth of data to examine since the attack in 2017 when Engerix-B was introduced. On average there were 29 deaths reported annually for fifteen years prior to the attack (2003 to 2017). In 2018 there were only 6 reported (to end of November 2018). Two of those deaths followed Recombivax.

The Lack of Legal Precedent for Modern Day U.S. Mandatory Vaccination Laws

No other country requires as many childhood vaccines as the U.S., but the legal edifice shoring up the compulsory childhood vaccine program is surprisingly flimsy. As New York University legal scholar Mary Holland explains in a 2010 working paper, this edifice relies primarily on two century-old Supreme Court decisions—from 1905 and 1922—and on the game-changing National Childhood Vaccine Injury Act (NCVIA) of 1986, which fundamentally altered the legal landscape for vaccination by exempting vaccine manufacturers and medical practitioners from liability for childhood vaccine injuries. The 1986 Act, in particular, resulted in an absence of legal protections for vaccinated children that is “striking compared to almost all other medical interventions.” Examining the legal trajectory of vaccine mandates since 1905, Holland argues that current childhood mandates are not only radically different from what the earlier courts and legislators envisioned but are “unreasonable and oppressive and have led to…perverse results” that do not safeguard children’s rights and health.
