Parent Denied Opportunity to Sue Merck After Collecting $250K “Blood Money” for MMR Vaccine Death of Child

Erin Holmes got $250,000 she didn’t want, “blood money” her husband didn’t want to spend. The money came from the Vaccine Injury Compensation Program for her son, Jacob, who died in 2002 from a brain condition after receiving his measles-mumps-rubella and varicella vaccines. The Vaccine Injury Compensation Program is funded by taxpayers via a tax on vaccines. Holmes didn’t want the money – but as an “angry parent” she wanted to do something more. So she reached out to a lawyer in Las Vegas who told her that the money she collected from the compensation program was “Jacob’s money” – and she could still sue for her own suffering. She filed a wrongful death lawsuit against Merck and Co. – a manufacturer of MMR, varicella and other vaccines – alleging “negligence, strict product liability, negligent design, failure to warn, misrepresentation, express warranty, implied warranty of merchantability, implied warranty of fitness for a particular purpose, and punitive damages,” according to court documents. But the 9th U.S. Circuit Court of Appeals ruled that Holmes could not sue for negligent design or failure to warn, because the National Childhood Vaccine Injury Act pre-empted Holmes’ strict product liability, negligent design and failure to warn claims. “If we were to conclude that the parents of those suffering a vaccine-related injury could bring design defect and failure to warn claims … we would be acting contrary to the statute’s central purpose of managing vaccine manufacturers’ liability because our construction would do little to protect the vaccine manufacturers from suit,” the court said in its opinion.

Merck’s Sales Soar on Measles Vaccine After Disney Outbreak

Bloomberg announced this week that Merck's MMR vaccine sales more than quadrupled after the California Disney measles outbreak. Of course, there is no single measles vaccine currently on the market, and one has to purchase the MMR (measles, mumps, rubella) vaccine which is a 3 in 1 combo vaccine. Merck has been involved in a long federal lawsuit with allegations of fraud over the mumps portion of the MMR vaccine, in a case filed back in 2010 by two whistleblowers, virologists who worked for Merck. There is also evidence that the MMR vaccine is killing more people than the measles virus, as there have been no deaths associated with measles according to the CDC, while there have been 108 deaths reported after the measles vaccine in the Vaccine Adverse Event Reporting System (VAERS). In addition, reports show that between 50% and 86% of those who came down with measles in the Disney outbreak were actually already vaccinated. None of that matters to Merck, obviously, as sales of the measles vaccine grew by over 24% during the first quarter of 2015.

Dr. Brownstein, M.D. – Human DNA From Fetal Cells in Measles Vaccine Could be Linked to Increase in Autism

The MMR vaccine (MMR ProQuad) contains aborted fetal lung tissue. This original fetus was aborted due to maternal psychiatric reasons in September, 1966. The MMR2 vaccine contains aborted fetal lung tissue of a 3-month old human female. These fetal cells are used because the human cells can be used to grow the measles virus. There is concern that the increase in autism that has occurred may be due to the introduction of human DNA–from fetal cells–in the MMR and chicken pox vaccines. A scientific review from Dr. Helen Ratajczak, a former scientist at a pharmaceutical firm, reviewed the body of published research since autism was first described in 1943. Dr. Ratajczak stated, “What I have published is highly concentrated on hypersensitivity. The body’s immune system is being thrown out of balance..” by the increasing number of vaccines given in a short period of time. She also felt that the introduction of human DNA contained in vaccines has markedly increased the risk of developing autism. Presently, human tissue is used in 23 vaccines. Dr. Ratajczak feels that the increased spike in autism may be related to the introduction of human DNA into the MMR and chicken pox vaccines.

Dr. Suzanne Humphries, M.D. – Vaccine Strain of Measles Virus Found in Measles Outbreaks

Dr. Suzanne Humphries is a practicing nephrologist (kidney physician). In this lecture, she addresses a study done in Croatia where a child who was vaccinated with the MMR vaccine was tested positive for the measles vaccine strain Schwarz eight days after vaccination. This was a significant finding, because the child's symptoms were thought to be similar to rubella, and without testing, the sickness would have been possibly mis-diagnosed as rubella, or the wild-type strain of measles the vaccine is designed to protect against. Since this study in 2010, others studies have also confirmed that those vaccinated with the MMR vaccine are susceptible to becoming infected with measles, the vaccine measles virus, and not the wild virus. Are health officials testing cases of measles in the current outbreak in the United States, to determine if the measles strain is the wild strain of the vaccine strain? Not likely, and it is not likely that the mainstream media "TV doctors" will even discuss this as they falsely vilify parents who choose not to administer the MMR vaccine to their children as the cause of these outbreaks. Some of these cases are confirmed to be among those who have received the MMR vaccine, and for those who have not been vaccinated, is it possible they were infected from those recently vaccinated when the vaccine was still "shedding," and that the vaccine-strain of measles was passed on from the vaccinated child to the unvaccinated child?

Judge: Lawsuit Against Merck’s MMR Vaccine Fraud to Continue

In a recent story that no mainstream media outlet reported, a Pennsylvania federal judge ruled in favor of whistleblowers who have accused Merck of lying about the efficacy of its mumps vaccine (currently only available in combo with MMR). We had to find this story posted on a couple of websites representing lawyers. The lawsuit is brought by two whistleblowers, virologists who worked for Merck and are accusing Merck of lying about the effectiveness of the mumps vaccine. This story did garner mainstream news coverage back in 2012, before Merck's attorneys appealed and tried to get the case thrown out of court. This week, U.S. District Judge C. Darnell Jones II ruled that the whistleblowers had sufficiently pled that Merck might have provided false statements to the government and that the direct purchasers had shown enough evidence to establish that these falsehoods could have helped the company gain a monopoly. It is certainly understandable why the mainstream media does not want to touch this story, given the fact that one of the lead authors on a CDC published study in 2004 has also become a whistleblower, stating that the CDC withheld data from the public linking the MMR vaccine to a higher rate of autism among some children, specifically African American boys.

A top research scientist working for the Centers for Disease Control and Prevention (CDC) played a key role in helping Dr. Brian Hooker of the Focus Autism Foundation uncover data manipulation by the CDC that obscured a higher incidence of autism in African-American boys. "We've missed ten years of research because the CDC is so paralyzed right now by anything related to autism. They're not doing what they should be doing because they're afraid to look for things that might be associated." The whistleblower alleges criminal wrongdoing of his supervisors, and he expressed deep regret about his role in helping the CDC hide data.

Students at Fordham University Experiencing Mumps Outbreak Even though They were Vaccinated Against It

WABC in New York is reporting that there is an outbreak of mumps among students at Fordham University. Ten students have been diagnosed with the virus. As you watch the report in this article, you will learn that all those affected had received the MMR (Measles, Mumps, Rubella) vaccine, as it is required for all students. The reporter makes this statement about the MMR vaccine: "It's important to know that it's (the vaccine) the best we have, but it is not perfect." This is not the first time that the MMR vaccine has been shown to be ineffective. In past outbreaks, however, the unvaccinated were always blamed. Given the 100% vaccination rate at this university, I wonder how they will get away with blaming the unvaccinated this time? The MMR vaccine is also controversial as there are over 28 studies linking it to autism.
